Artificial intelligence is rapidly transforming professional practice, and dispute resolution is no exception. With thousands of AI platforms now available and new tools emerging almost daily, mediators, arbitrators, and other dispute resolution professionals face a pressing question: how can AI be used responsibly, effectively, and ethically without compromising the human judgment at the heart of their work?
This book provides a practical and thoughtful guide to the integration of AI into mediation and related dispute resolution processes. Rather than focusing on specific technologies that may quickly become obsolete, it is grounded in the enduring principles, professional standards, and ethical obligations that define effective dispute resolution. The authors examine AI’s role at every stage of the mediation process, from the initial decision whether to use AI at all, through disclosure, information management, communication support, and the generation of settlement options. Drawing on established ethical frameworks, including the Universal Disclosure Protocol for Mediation and guidance developed by leading dispute resolution organizations, the book offers concrete recommendations, best practices, and cautionary examples. It explores the possibility of AI functioning not merely as a tool, but as a “fourth party” or co-mediator, while emphasizing the continuing responsibility of human professionals.
Essential reading for mediators, arbitrators, lawyers, and dispute resolution practitioners, this book provides a clear framework for navigating the opportunities and challenges of AI in the pursuit of fair, informed, and consensual outcomes.
