Learning from Greensboro

Legacies of Fukushima

Already by the end of the fourteenth century, the public gifts had their darker counterparts. References appear to more dangerous gifts, usually associated with the male body: from the hands of the corrupt scribe, to the skin of the venal judge, to the private parts of the body politic. A new vocabulary appears in law books, oath formulas, and polemical writing to refer to simony and usury, to Judas's reward, and to the sin of sodomy—in short, to underhanded and invisible relationships in which liquid gifts and bodily fluids mingled in unspeakable ways.

The grand landscapes, open vistas, and magisterial views have made the act of looking a defining feature of how we experience the West as an actual place. In Looking West, John D. Dorst examines a largely neglected pattern of seeing that stands in contrast to the universally familiar iconography.
When we engage in the act of looking, contends Dorst, we inevitably do so according to historically determined patterns—"discourses of seeing." It is a central premise of Looking West that over roughly the last one hundred years the American West, both as a physical location and as an imagined place, has been an important laboratory for the production of modern visual discourses.
Through a series of Western texts—folkloric, photographic, literary, and historical—Dorst outlines another pattern of looking West, one characterized by optical distortion, faulty vision, and the ambiguous intersection of spectatorship, display, and covert observation. He applies the insights gained from this analysis of discursive patterns to various cultural displays located in the contemporary West. Inal argues that three conditions are necessary for the emergence of a global prohibition regime: first, a state must believe that it is necessary to comply with the prohibition and that to do otherwise would be costly; second, the idea that a particular practice is undesirable must become the norm; finally, a prohibition regime emerges with state and nonstate actors supporting it all along the way. These conditions are met by the prohibition against pillage, which developed from a confluence of material circumstances and an ideological context: the nineteenth century fostered ideas about the sanctity of private property, which made the act of looting seem more abhorrent. Meanwhile, the existence of conscripted and regulated armies meant that militaries could take measures to prevent it. In that period, however, rape was still considered a crime of passion or a symptom of behavioral disorder—in other words, a distortion of male sexuality and outside of state control—and it would take many decades to erode the grip of those ideas. Only toward the end of the twentieth century did transformations in gender ideology and the increased participation of women in politics bring about broad cultural shifts in the way we perceive sexual violence, women, and women's roles in policy and lawmaking.

Regular price $90.00 Save $-90.00In the mid-nineteenth century, Jacob Grimm published a collection of late medieval records of local law—called Weistümer—that was scarcely less comprehensive than his famous collection of fairy tales. As with the fairy tales, Grimm assumed that before their transcription, people had handed these down orally from time immemorial. His interest in these customary laws arose from their seemingly folkloristic notions of custom and from their poetic narratives about ritualized encounters between lords and peasants, capturing an oral tradition from an unsophisticated time.
Grimm's readings are still used today as a basis for theories about oral societies in the premodern West and contemporary non-Western societies and the modernizing effects of writing. As Simon Teuscher contends, however, those aspects of legal texts that have been considered since Grimm to be vestiges of a traditional preliterate popular culture were eventually rooted in relatively advanced and learned techniques of writing, jurisprudence, and administration. Lords' Rights and Peasant Stories uses examples from German- and French-speaking Switzerland to investigate what legal order meant to individuals and to a society at the eve of the early modern period. Teuscher deals with legal documents not only as texts, but also as objects. The book takes the materiality of documents seriously and reconstructs cultural techniques of their production and social practices of their use.
Lords' Rights and Peasant Stories suggests the need to rethink master narratives about transitions from oral to literate societies. It explores the local dimensions of processes of state-formation and the emergence of modern notions of law in western Europe.
