Regular price $90.00 Save $-90.00In the mid-nineteenth century, Jacob Grimm published a collection of late medieval records of local law—called Weistümer—that was scarcely less comprehensive than his famous collection of fairy tales. As with the fairy tales, Grimm assumed that before their transcription, people had handed these down orally from time immemorial. His interest in these customary laws arose from their seemingly folkloristic notions of custom and from their poetic narratives about ritualized encounters between lords and peasants, capturing an oral tradition from an unsophisticated time.
Grimm's readings are still used today as a basis for theories about oral societies in the premodern West and contemporary non-Western societies and the modernizing effects of writing. As Simon Teuscher contends, however, those aspects of legal texts that have been considered since Grimm to be vestiges of a traditional preliterate popular culture were eventually rooted in relatively advanced and learned techniques of writing, jurisprudence, and administration. Lords' Rights and Peasant Stories uses examples from German- and French-speaking Switzerland to investigate what legal order meant to individuals and to a society at the eve of the early modern period. Teuscher deals with legal documents not only as texts, but also as objects. The book takes the materiality of documents seriously and reconstructs cultural techniques of their production and social practices of their use.
Lords' Rights and Peasant Stories suggests the need to rethink master narratives about transitions from oral to literate societies. It explores the local dimensions of processes of state-formation and the emergence of modern notions of law in western Europe. Students of rural society and village organization will find here a discussion of local power distribution that is inspired by social anthropology, that looks beyond simple antagonisms between lords and peasants, and that insists on the role of state servants and the unconscious effects of their writing practices.

Love Entwined
Regular price $64.95 Save $-64.95In the largely forgotten craft of hairwork, practiced widely in nineteenth-century America, the hair of loved ones—living and deceased—was woven into jewelry, wall decorations, and keepsakes. Rings, bracelets, lockets, and brooches were set with metalwork or ivory and painted with rich patterns. Pocket watches hung from long, woven hair fobs. Parlor walls were decorated with elaborate wreaths made of hair fashioned into twigs and flowers, often adorned with beads or ribbons. They have no fixed line or meter, no consistent point of view, and their content may seem misaligned with the other texts in manuscripts in which they are found. Yet in Lyric Tactics, Ingrid Nelson argues that the lyric poetry of later medieval England is a distinct genre defined not by its poetic features—rhyme, meter, and stanza forms—but by its modes of writing and performance, which are ad hoc, improvisatory, and situational. Early-nineteenth century Philadelphia house artisans also formulated an important new strategy: they acquired credit and built on speculation. Such practices drew them deeply into a competitive and volatile economy, and artisans in the Philadelphia construction trades responded as spirited, innovative entrepreneurs who plunged wholeheartedly into the dangers and rewards of capitalism. When credit flowed, they competed for contracts to build ten, twenty, even forty houses at a time. When business slowed during the economic depressions of the period, they ferreted out small jobs, repairs, renovations, and custom work.
In Making Houses, Crafting Capitalism, Donna J. Rilling follows the work of entrepreneurial builders, from the procurement of bricks and mortar to the eventual marketing and sale of a finished house. By tracing these activities, Rilling demonstrates the diverse ways capital markets, worksites, raw materials, and the real estate business changed over six decades. She finds that officials face steep challenges in this work as they grapple with deeply unequal and asymmetrical relationships with Russia, donor states, and international experts, while coming face-to-face with postcolonial legacies from the Soviet past. By exploring relationships between history, pedagogy, and law in migration bureaucracy, Bahovadinova highlights the limited possibilities available to officials in global migration management, asks how governmental ideas and practices develop, and uncovers the challenges that transnational citizens face when they leave their countries to work without forfeiting their original citizenship.

Making Seafood Sustainable analyzes the ramifications of overfishing for the United States by investigating how fishers, seafood processors, retailers, government officials, and others have worked together to respond to the crisis. Historian Mansel G. Blackford examines how these players took steps to make fishing in some American waters, especially in Alaskan waters, sustainable. Critical to these efforts, Blackford argues, has been government and industry collaboration in formulating and enforcing regulations. What can be learned from these successful experiences?
